NDPS Act deals with narcotic drugs and makes stringent provisions for the control and regulation of
operations relating to narcotic drugs and psychotropic substances. It also provides the forfeiture of property
derived from, or used in, illicit traffic in narcotic drugs and psychotropic substances and is guided by the
provisions of the International Conventions on Narcotic Drugs and Psychotropic Substances. The 1985 Act
provides constitution of special court for speedy trial of the offences punishable under the Act and the
proceedings including the appeal and revision is dealt by the provisions of Criminal Procedure Code, 1973.
The Central Government, under the NDPS Act, authorises the Competent Authority to perform the functions
relating to forfeiture of illegally acquired property and the orders passed by the Competent Authority are
appealable before the Appellate Tribunal under the Smugglers and Foreign Exchange Manipulators
(Forfeiture of Property) Act, 1976.
